The term sociopath is no longer used to describe this disorder. The sociopath is now described as someone with antisocial personality disorder.<br />The main characteristic of a sociopath is a disregard for the rights of others. Sociopaths are also unable to conform to what society defines as a normal personality. Antisocial tendencies are a big part of the sociopath’s personality. This pattern usually comes into evidence around the age of 15. If it is not treated, it can develop into adulthood.<br />Visible symptoms include physical aggression and the inability to hold down a steady job. The sociopath also finds it hard to sustain relationships and shows a lack of regret in his or her actions. A major personality behavior trait is the violation of the rights of others. This can appear as a disregard for the physical or sexual wellbeing of another.<br />Although these symptoms are all present, they may not always be evident. Research has shown that the sociopath is usually a person with an abundance of charm and wit. He or she may appear friendly and considerate, but these attributes are usually superficial. They are used as a way of blinding the other person to the personal agenda behind the sociopath’s behaviour.<br />Many people with antisocial personality disorder frequently indulge in alcohol or drug use. They may use these substances heavily as a way of heightening their antisocial personality. The sociopath sometimes sees the world on his or her own terms, as a place of high drama and risky thrills. The sociopath may suffer from low self esteem, and the use of alcohol and drugs is a way to diminish these feelings.<br />The causes of antisocial personality disorder are thought to be either genetic or environmental. Children who are influenced by antisocial parents may adopt these tendencies. Similarly, role models such as one's friends or peer group may also influence the behaviour pattern of a sociopath. Antisocial behaviour is more likely to occur in men than in women. About 1% of women have this disorder, while 3% of men are affected by it.<br />It is very rare for a person with antisocial personality disorder to seek help of their own accord. Treatment for antisocial personality disorder is usually through group <a href="http://www.wisegeek.com/what-is-psychotherapy.htm">psychotherapy</a>. Sociopaths often find it helpful to talk through and recognize their problems with people they can trust. Praktik kedokteran adalah rangkaian kegiatan yang dilakukan oleh dokter dan dokter gigi terhadap pasien dalam melaksanakan upaya kesehatan. 2. Dokter dan dokter gigi adalah dokter, dokter spesialis, dokter gigi, dan dokter gigi spesialis lulusan pendidikan kedokteran atau kedokteran gigi baik di dalam maupun di luar negeri yang diakui oleh Pemerintah Republik Indonesia sesuai dengan peraturan perundang-undangan. 3. Konsil Kedokteran Indonesia adalah suatu badan otonom, mandiri, nonstruktural, dan bersifat independen, yang terdiri atas Konsil Kedokteran dan Konsil Kedokteran Gigi. 4. Sertifikat kompetensi adalah surat tanda pengakuan terhadap kemampuan seorang dokter atau dokter gigi untuk menjalankan praktik kedokteran di seluruh Indonesia setelah lulus uji kompetensi. 5. Registrasi adalah pencatatan resmi terhadap dokter dan dokter gigi yang telah memiliki sertifikat kompetensi dan telah mempunyai kualifikasi tertentu lainnya serta diakui secara hukum untuk melakukan tindakan profesinya. 6. Registrasi ulang adalah pencatatan ulang terhadap dokter dan dokter gigi yang telah diregistrasi setelah memenuhi persyaratan yang berlaku. 7. Surat izin praktik adalah bukti tertulis yang diberikan pemerintah kepada dokter dan dokter gigi yang akan menjalankan praktik kedokteran setelah memenuhi persyaratan. 3<br />8. Surat tanda registrasi dokter dan dokter gigi adalah bukti tertulis yang diberikan oleh Konsil Kedokteran Indonesia kepada dokter dan dokter gigi yang telah diregistrasi. 9. Sarana pelayanan kesehatan adalah tempat penyelenggaraan upaya pelayanan kesehatan yang dapat digunakan untuk praktik kedokteran atau kedokteran gigi. 10. Pasien adalah setiap orang yang melakukan konsultasi masalah kesehatannya untuk memperoleh pelayanan kesehatan yang diperlukan baik secara langsung maupun tidak langsung kepada dokter atau dokter gigi. 11. Profesi kedokteran atau kedokteran gigi adalah suatu pekerjaan kedokteran atau kedokteran gigi yang dilaksanakan berdasarkan suatu keilmuan, kompetensi yang diperoleh melalui pendidikan yang berjenjang, dan kode etik yang bersifat melayani masyarakat. 12. Organisasi profesi adalah Ikatan Dokter Indonesia untuk dokter dan Persatuan Dokter Gigi Indonesia untuk dokter gigi. 13. Kolegium kedokteran Indonesia dan kolegium kedokteran gigi Indonesia adalah badan yang dibentuk oleh organisasi profesi untuk masing-masing cabang disiplin ilmu yang bertugas mengampu cabang disiplin ilmu tersebut. 14. Majelis Kehormatan Disiplin Kedokteran Indonesia adalah lembaga yang berwenang untuk menentukan ada tidaknya kesalahan yang dilakukan dokter dan dokter gigi dalam penerapan disiplin ilmu kedokteran dan kedokteran gigi, dan menetapkan sanksi. 15. Menteri adalah menteri yang tugas dan tanggung jawabnya di bidang kesehatan. <br /><br />BAB II ASAS DAN TUJUAN <br />Pasal 2 Praktik kedokteran dilaksanakan berasaskan Pancasila dan didasarkan pada nilai ilmiah, manfaat, keadilan, kemanusiaan, keseimbangan, serta perlindungan dan keselamatan pasien.<br />Pasal 3 Pengaturan praktik kedokteran bertujuan untuk :<br />a. memberikan perlindungan kepada pasien; b. mempertahankan dan meningkatkan mutu pelayanan medis yang diberikan oleh dokter dan dokter gigi; dan c. memberikan kepastian hukum kepada masyarakat, dokter dan dokter gigi. 4<br /><br />BAB III KONSIL KEDOKTERAN INDONESIA<br />Bagian Kesatu<br />Nama dan Kedudukan<br />Pasal 4<br />(1) Untuk melindungi masyarakat penerima jasa pelayanan kesehatan dan meningkatkan mutu pelayanan kesehatan dari dokter dan dokter gigi dibentuk Konsil Kedokteran Indonesia yang terdiri atas Konsil Kedokteran dan Konsil Kedokteran Gigi. (2) Konsil Kedokteran Indonesia sebagaimana bertanggung jawab kepada Presiden. dimaksud pada ayat (1) Konsil Kedokteran Indonesia. Pasal 5 Indonesia berkedudukan di ibu kota negara Republik<br />Bagian Kedua<br />Fungsi, Tugas, dan Wewenang<br />Pasal 6 Konsil Kedokteran Indonesia mempunyai fungsi pengaturan, pengesahan, penetapan, serta pembinaan dokter dan dokter gigi yang menjalankan praktik kedokteran, dalam rangka meningkatkan mutu pelayanan medis.<br />Pasal 7<br />(1) Konsil Kedokteran Indonesia mempunyai tugas : a. melakukan registrasi dokter dan dokter gigi; b. mengesahkan standar pendidikan profesi dokter dan dokter gigi; dan c. melakukan pembinaan terhadap penyelenggaraan praktik kedokteran yang dilaksanakan bersama lembaga terkait sesuai dengan fungsi masing-masing. (2) Standar pendidikan profesi dokter dan dokter gigi yang disahkan Konsil sebagaimana dimaksud pada ayat (1) huruf b ditetapkan bersama oleh Konsil Kedokteran Indonesia dengan kolegium kedokteran, kolegium kedokteran gigi, asosiasi institusi pendidikan kedokteran, asosiasi institusi pendidikan kedokteran gigi, dan asosiasi rumah sakit pendidikan. Pasal 8 Dalam menjalankan tugas sebagaimana dimaksud dalam Pasal 7 Konsil Kedokteran Indonesia mempunyai wewenang :<br />a. menyetujui dan menolak permohonan registrasi dokter dan dokter gigi; b. menerbitkan dan mencabut surat tanda registrasi dokter dan dokter gigi; 5<br />c. mengesahkan standar kompetensi dokter dan dokter gigi; d. e. f. g. melakukan pengujian terhadap persyaratan registrasi dokter dan dokter gigi; mengesahkan penerapan cabang ilmu kedokteran dan kedokteran gigi; melakukan pembinaan bersama terhadap dokter dan dokter gigi mengenai pelaksanaan etika profesi yang ditetapkan oleh organisasi profesi; dan melakukan pencatatan terhadap dokter dan dokter gigi yang dikenakan sanksi oleh organisasi profesi atau perangkatnya karena melanggar ketentuan etika profesi. Pasal 9<br />Ketentuan lebih lanjut mengenai fungsi dan tugas Konsil Kedokteran Indonesia diatur dengan Peraturan Konsil Kedokteran Indonesia.<br />Pasal 10 Ketentuan lebih lanjut mengenai pelaksanaan fungsi, tugas, dan wewenang Konsil Kedokteran dan Konsil Kedokteran Gigi diatur dengan Peraturan Konsil Kedokteran dan Konsil Kedokteran Gigi.<br />Bagian Ketiga<br />Susunan Organisasi dan Keanggotaan<br />Pasal 11<br />(1) Susunan organisasi Konsil Kedokteran Indonesia terdiri atas: a. Konsil Kedokteran; dan b. Konsil Kedokteran Gigi. (2) Konsil Kedokteran dan Konsil Kedokteran Gigi sebagaimana dimaksud pada ayat (1) masing-masing terdiri atas 3 (tiga) divisi, yaitu : a. Divisi Registrasi; b. Divisi Standar Pendidikan Profesi; dan c. Divisi Pembinaan. Pasal 12<br />(1) Pimpinan Konsil Kedokteran Indonesia terdiri atas : a. pimpinan Konsil Kedokteran Indonesia yang terdiri atas 3 (tiga) orang merangkap anggota; b. pimpinan Konsil Kedokteran dan pimpinan Konsil Kedokteran Gigi masingmasing 1 (satu) orang merangkap anggota; dan c. pimpinan divisi pada Konsil Kedokteran dan Konsil Kedokteran Gigi masing-masing 1 (satu) orang merangkap anggota. (2) Pimpinan Konsil Kedokteran Indonesia sebagaimana dimaksud pada ayat (1) bekerja secara kolektif. (3) Pimpinan Konsil Kedokteran Indonesia sebagaimana dimaksud pada ayat (1) huruf a adalah penanggung jawab tertinggi. 6<br />Pasal 13<br />(1) Pimpinan Konsil Kedokteran Indonesia terdiri atas seorang ketua dan (dua) orang wakil ketua. (2) Pimpinan Konsil Kedokteran terdiri atas seorang ketua dan 3 (tiga) orang ketua divisi. (3) Pimpinan Konsil Kedokteran Gigi terdiri atas seorang ketua dan 3 (tiga) orang ketua divisi. Pasal 14<br />(1) Jumlah anggota Konsil Kedokteran Indonesia 17 (tujuah belas) orang yang terdiri atas unsur-unsur yang berasal dari : a. organisasi profesi kedokteran 2 (dua) orang; b. organisasi profesi kedokteran gigi 2 (dua) orang; c. asosiasi institusi pendidikan kedokteran 1 (satu) orang; d. asosiasi institusi pendidikan kedokteran gigi 1 (satu) orang; e. kolegium kedokteran 1 (satu) orang; f. kolegium kedokteran gigi 1 (satu) orang; g. asosiasi rumah sakit pendidikan 2 (dua) orang; h. tokoh masyarakat 3 (tiga) orang; i. Departemen Kesehatan 2 (dua) orang; dan j. Departemen Pendidikan Nasional 2 (dua) orang. (2) Tata cara pemilihan tokoh masyarakat sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Konsil Kedokteran Indonesia. (3) Keanggotaan Konsil Kedokteran Indonesia ditetapkan oleh Presiden atas usul Menteri. (4) Menteri dalam mengusulkan keanggotaan Konsil Kedokteran Indonesia harus berdasarkan usulan dari organisasi dan asosiasi sebagaimana dimaksud pada ayat (1). (5) Ketentuan mengenai tata cara pengangkatan keanggotaan Konsil Kedokteran Indonesia diatur dengan Peraturan Presiden. Pasal 15 Pimpinan Konsil Kedokteran Indonesia, pimpinan Konsil Kedokteran, pimpinan Konsil Kedokteran Gigi, pimpinan divisi pada Konsil Kedokteran dan Konsil Kedokteran Gigi dipilih oleh anggota dan ditetapkan oleh rapat pleno anggota.<br />Pasal 16 Masa bakti keanggotaan Konsil Kedokteran Indonesia adalah 5 (lima) tahun dan dapat diangkat kembali untuk 1 (satu) kali masa jabatan berikutnya.<br />7<br />Pasal 17<br />(1) Anggota Konsil Kedokteran Indonesia sebelum memangku jabatan wajib mengucapkan sumpah/janji, menurut agamanya di hadapan Presiden. (2) Sumpah/janji sebagaimana dimaksud pada ayat (1) berbunyi sebagai berikut : ?Saya bersumpah/berjanji dengan sungguh-sungguh bahwa saya untuk melaksanakan tugas ini, langsung atau tidak langsung, dengan menggunakan nama atau cara apapun juga, tidak memberikan atau menjanjikan sesuatu apapun kepada siapapun juga.<br />Saya bersumpah/berjanji bahwa saya, untuk melakukan atau tidak melakukan sesuatu dalam tugas ini, tidak sekali-kali akan menerima langsung atau tidak langsung dari siapapun juga suatu janji atau pemberian.<br />Saya bersumpah/berjanji bahwa saya dalam menjalankan tugas ini, senantiasa menjunjung tinggi ilmu kedokteran atau kedokteran gigi dan mempertahankan serta meningkatkan mutu pelayanan dokter atau dokter gigi.<br />Saya bersumpah/berjanji bahwa saya akan setia dan taat kepada dan akan mempertahankan serta mengamalkan Pancasila sebagai dasar negara, Undang-undang Dasar Negara Republik Indonesia Tahun 1945, serta peraturan perundang-undangan yang berlaku bagi Negara Republik Indonesia.<br />Saya bersumpah/berjanji bahwa saya senantiasa akan menjalankan tugas dan wewenang saya ini dengan sungguh-sungguh saksama, obyektif, jujur, berani, adil, tidak membeda-bedakan jabatan, suku, agama, ras, jender, dan golongan tertentu dan akan melaksanakan kewajiban saya dengan sebaikbaiknya, serta bertanggung jawab sepenuhnya kepada Tuhan Yang Maha Esa, masyarakat, bangsa dan negara.<br />Saya bersumpah/berjanji bahwa saya senantiasa akan menolak atau tidak menerima atau tidak mau dipengaruhi oleh campur tangan siapapun juga dan saya akan tetap teguh melaksanakan tugas dan wewenang saya yang diamanatkan Undang-Undang kepada saya ?.<br />Pasal 18<br />Untuk dapat diangkat sebagai anggota Konsil Kedokteran Indonesia, yang<br />bersangkutan harus memenuhi syarat sebagai berikut :<br />a. warga negara Republik Indonesia; b. sehat jasmani dan rohani; c. bertakwa kepada Tuhan Yang Maha Esa dan berakhlak mulia; d. berkelakuan baik; 8<br />e. berusia sekurang-kurangnya 40 (empat puluh) tahun dan setinggi-tingginya 65 (enam puluh lima) tahun pada waktu menjadi anggota Konsil Kedokteran Indonesia; f. pernah melakukan praktik kedokteran paling sedikit 10 (sepuluh) tahun dan memiliki surat tanda registrasi dokter atau surat tanda registrasi dokter gigi, kecuali untuk wakil dari masyarakat; g. cakap, jujur, memiliki moral, etika dan integritas yang tinggi serta memiliki reputasi yang baik; dan h. melepaskan jabatan struktural dan/atau jabatan lainnya pada saat diangkat dan selama menjadi anggota Konsil Kedokteran Indonesia. Pasal 19<br />(1) Anggota Konsil Kedokteran Indonesia berhenti atau diberhentikan karena : a. berakhir masa jabatan sebagai anggota; b. mengundurkan diri atas permintaan sendiri; c. meninggal dunia; d. bertempat tinggal tetap di luar wilayah Republik Indonesia; e. tidak mampu lagi melakukan tugas secara terus-menerus selama 3 (tiga) bulan; atau f. dipidana karena melakukan tindak pidana kejahatan berdasarkan putusan pengadilan yang telah memperoleh kekuatan hukum tetap. (2) Dalam hal anggota Konsil Kedokteran Indonesia menjadi tersangka tindak pidana kejahatan, diberhentikan sementara dari jabatannya. (3) Pemberhentian sementara sebagaimana dimaksud pada ayat (2) ditetapkan oleh Ketua Konsil Kedokteran Indonesia. (4) Pengusulan pemberhentian sebagaimana dimaksud pada ayat (1) diajukan oleh Menteri kepada Presiden. Pasal 20<br />(1) Dalam melaksanakan tugas dan wewenangnya Konsil Kedokteran Indonesia dibantu sekretariat yang dipimpin oleh seorang sekretaris. (2) Sekretaris diangkat dan diberhentikan oleh Menteri. (3) Sekretaris sebagaimana dimaksud pada ayat (2) bukan anggota Konsil Kedokteran Indonesia. (4) Dalam menjalankan tugasnya sekretaris bertanggung jawab kepada pimpinan Konsil Kedokteran Indonesia. (5) Ketentuan fungsi dan tugas sekretaris ditetapkan oleh Ketua Konsil Kedokteran Indonesia. 9<br />Pasal 21<br />(1) Pelaksanaan tugas sekretariat dilakukan oleh pegawai Konsil Kedokteran Indonesia. (2) Pegawai sebagaimana dimaksud pada ayat (1) tunduk pada peraturan perundang-undangan tentang kepegawaian. Bagian Keempat<br />Tata Kerja<br />Pasal 22<br />(1) Setiap keputusan Konsil Kedokteran Indonesia yang bersifat mengatur diputuskan oleh rapat pleno anggota. (2) Rapat pleno Konsil Kedokteran Indonesia dianggap sah jika dihadiri oleh paling sedikit setengah dari jumlah anggota ditambah satu. (3) Keputusan diambil dengan cara musyawarah untuk mufakat. (4) Dalam hal tidak terdapat kesepakatan sebagaimana dimaksud pada ayat (3), maka dapat dilakukan pemungutan suara. Pasal 23 Pimpinan Konsil Kedokteran Indonesia melakukan pembinaan terhadap pelaksanaan tugas anggota dan pegawai konsil agar pelaksanaan tugas dilakukan sesuai dengan ketentuan peraturan perundang-undangan.<br />Pasal 24 Ketentuan lebih lanjut mengenai tata kerja Konsil Kedokteran Indonesia diatur dengan Peraturan Konsil Kedokteran Indonesia.<br />Bagian Kelima<br />Pembiayaan<br />Pasal 25 Biaya untuk pelaksanaan tugas-tugas Konsil Kedokteran Indonesia dibebankan kepada Anggaran Pendapatan dan Belanja Negara.<br /><br />BAB IV STANDAR PENDIDIKAN PROFESI KEDOKTERAN DAN KEDOKTERAN GIGI <br />Pasal 26<br />(1) Standar pendidikan profesi kedokteran dan standar pendidikan profesi kedokteran gigi disahkan oleh Konsil Kedokteran Indonesia. (2) Standar pendidikan profesi kedokteran dan standar pendidikan profesi kedokteran gigi sebagaimana dimaksud pada ayat (1) : 10<br />a. untuk pendidikan profesi dokter atau dokter gigi disusun oleh asosiasi institusi pendidikan kedokteran atau kedokteran gigi; dan b. untuk pendidikan profesi dokter spesialis atau dokter gigi spesialis disusun oleh kolegium kedokteran atau kedokteran gigi. (3) Asosiasi institusi pendidikan kedokteran atau kedokteran gigi dalam menyusun standar pendidikan profesi sebagaimana dimaksud pada ayat (2) huruf a berkoordinasi dengan organisasi profesi, kolegium, asosiasi rumah sakit pendidikan, Departemen Pendidikan Nasional, dan Departemen Kesehatan. (4) Kolegium kedokteran atau kedokteran gigi dalam menyusun standar pendidikan profesi sebagaimana dimaksud pada ayat (2) huruf b berkoordinasi dengan organisasi profesi, asosiasi institusi pendidikan kedokteran atau kedokteran gigi, asosiasi rumah sakit pendidikan, Departemen Pendidikan Nasional, dan Departemen Kesehatan. <br /><br />BAB V PENDIDIKAN DAN PELATIHAN KEDOKTERAN DAN KEDOKTERAN GIGI <br />Pasal 27 Pendidikan dan pelatihan kedokteran atau kedokteran gigi, untuk memberikan kompetensi kepada dokter atau dokter gigi, dilaksanakan sesuai dengan standar pendidikan profesi kedokteran atau kedokteran gigi.<br />Pasal 28<br />(1) Setiap dokter atau dokter gigi yang berpraktik wajib mengikuti pendidikan dan pelatihan kedokteran atau kedokteran gigi berkelanjutan yang diselenggarakan oleh organisasi profesi dan lembaga lain yang diakreditasi oleh organisasi profesi dalam rangka penyerapan perkembangan ilmu pengetahuan dan teknologi kedokteran atau kedokteran gigi. (2) Pendidikan dan pelatihan kedokteran atau kedokteran gigi berkelanjutan sebagaimana dimaksud pada ayat (1) dilaksanakan sesuai dengan standar yang ditetapkan oleh organisasi profesi kedokteran atau kedokteran gigi. <br /><br />BAB VI REGISTRASI DOKTER DAN DOKTER GIGI<br />Pasal 29<br />(1) Setiap dokter dan dokter gigi yang melakukan praktik kedokteran di Indonesia wajib memiliki surat tanda registrasi dokter dan surat tanda registrasi dokter gigi. (2) Surat tanda registrasi dokter dan surat tanda registrasi dokter gigi sebagaimana dimaksud pada ayat (1) diterbitkan oleh Konsil Kedokteran Indonesia. 11<br />(3) Untuk memperoleh surat tanda registrasi dokter dan surat tanda registrasi dokter gigi harus memenuhi persyaratan : a. memiliki ijazah dokter, dokter spesialis, dokter gigi, atau dokter gigi spesialis; b. mempunyai surat pernyataan telah mengucapkan sumpah/janji dokter atau dokter gigi; c. memiliki surat keterangan sehat fisik dan mental; d. memiliki sertifikat kompetensi; dan e. membuat pernyataan akan mematuhi dan melaksanakan ketentuan etika profesi. (4) Surat tanda registrasi dokter dan surat tanda registrasi dokter gigi berlaku selama 5 (lima) tahun dan diregistrasi ulang setiap 5 (lima) tahun sekali dengan tetap memenuhi persyaratan sebagaimana dimaksud pada ayat (3) huruf c dan huruf d. (5) Ketua konsil kedokteran dan ketua konsil kedokteran gigi dalam melakukan registrasi ulang harus mendengar pertimbangan ketua divisi registrasi dan ketua divisi pembinaan. (6) Ketua konsil kedokteran dan ketua konsil kedokteran gigi berkewajiban untuk memelihara dan menjaga registrasi dokter dan dokter gigi. Pasal 30<br />(1) Dokter dan dokter gigi lulusan luar negeri yang akan melaksanakan praktik kedokteran di Indonesia harus dilakukan evaluasi. (2) Evaluasi sebagaimana dimaksud pada ayat (1) meliputi: a. kesahan ijazah; b. kemampuan untuk melakukan praktik kedokteran yang dinyatakan dengan surat keterangan telah mengikuti program adaptasi dan sertifikat kompetensi; c. mempunyai surat pernyataan telah mengucapkan sumpah/janji dokter atau dokter gigi; d. memiliki surat keterangan sehat fisik dan mental; dan e. membuat pernyataan akan mematuhi dan melaksanakan ketentuan etika profesi. (3) Dokter dan dokter gigi warga negara asing selain memenuhi ketentuan sebagaimana dimaksud pada ayat (2) juga harus melengkapi surat izin kerja sesuai dengan ketentuan peraturan perundang-undangan dan kemampuan berbahasa Indonesia. (4) Dokter dan dokter gigi yang telah memenuhi ketentuan sebagaimana dimaksud pada ayat (2) dan ayat (3) diberikan surat tanda registrasi dokter atau surat tanda registrasi dokter gigi oleh Konsil Kedokteran Indonesia. 12<br />Pasal 31<br />(1) Surat tanda registrasi sementara dapat diberikan kepada dokter dan dokter gigi warga negara asing yang melakukan kegiatan dalam rangka pendidikan, pelatihan, penelitian, pelayanan kesehatan di bidang kedokteran atau kedokteran gigi yang bersifat sementara di Indonesia. (2) Surat tanda registrasi sementara berlaku selama 1 (satu) tahun dan dapat diperpanjang untuk 1 (satu) tahun berikutnya. (3) Surat tanda registrasi sementara diberikan apabila telah memenuhi ketentuan sebagaimana dimaksud dalam Pasal 30 ayat (2). Pasal 32<br />(1) Surat tanda registrasi bersyarat diberikan kepada peserta program pendidikan dokter spesialis atau dokter gigi spesialis warga negara asing yang mengikuti pendidikan dan pelatihan di Indonesia. (2) Dokter atau dokter gigi warga negara asing yang akan memberikan pendidikan dan pelatihan dalam rangka alih ilmu pengetahuan dan teknologi untuk waktu tertentu, tidak memerlukan surat tanda registrasi bersyarat. (3) Dokter atau dokter gigi warga negara asing sebagaimana dimaksud pada ayat (2) harus mendapat persetujuan dari Konsil Kedokteran Indonesia. (4) Surat tanda registrasi dan persetujuan sebagaimana dimaksud pada ayat (1) dan ayat (3) diberikan melalui penyelenggara pendidikan dan pelatihan. Pasal 33 Surat tanda registrasi tidak berlaku karena :<br />a. dicabut atas dasar ketentuan peraturan perundang-undangan; b. habis masa berlakunya dan yang bersangkutan tidak mendaftar ulang; c. atas permintaan yang bersangkutan; d. yang bersangkutan meninggal dunia; atau e. dicabut Konsil Kedokteran Indonesia.<br />Pasal 34 Ketentuan lebih lanjut mengenai tata cara registrasi, registrasi ulang, registrasi sementara, dan registrasi bersyarat diatur dengan Peraturan Konsil Kedokteran Indonesia.<br />Pasal 35<br />(1) Dokter atau dokter gigi yang telah memiliki surat tanda registrasi mempunyai wewenang melakukan praktik kedokteran sesuai dengan pendidikan dan kompetensi yang dimiliki, yang terdiri atas: a. mewawancarai pasien; b. memeriksa fisik dan mental pasien; c. menentukan pemeriksaan penunjang; d. menegakkan diagnosis; e. menentukan penatalaksanaan dan pengobatan pasien; 13<br />f. melakukan tindakan kedokteran atau kedokteran gigi; g. menulis resep obat dan alat kesehatan; h. menerbitkan surat keterangan dokter atau dokter gigi; i. menyimpan obat dalam jumlah dan jenis yang diizinkan; dan j. meracik dan menyerahkan obat kepada pasien, bagi yang praktik di daerah terpencil yang tidak ada apotek. (2) Selain kewenangan sebagaimana dimaksud pada ayat (1) kewenangan lainnya diatur dengan Peraturan Konsil Kedokteran Indonesia. <br /><br />BAB VII PENYELENGGARAAN PRAKTIK KEDOKTERAN<br />Bagian Kesatu<br />Surat Izin Praktik<br />Pasal 36 Setiap dokter dan dokter gigi yang melakukan praktik kedokteran di Indonesia wajib memiliki surat izin praktik.<br />Pasal 37<br />(1) Surat izin praktik sebagaimana dimaksud dalam Pasal 36 dikeluarkan oleh pejabat kesehatan yang berwenang di kabupaten/kota tempat praktik kedokteran atau kedokteran gigi dilaksanakan. (2) Surat izin praktik dokter atau dokter gigi sebagaimana dimaksud pada ayat (1) hanya diberikan untuk paling banyak 3 (tiga) tempat. (3) Satu surat izin praktik hanya berlaku untuk 1 (satu) tempat praktik. Pasal 38<br />(1) Untuk mendapatkan surat izin praktik sebagaimana dimaksud dalam Pasal 36, dokter atau dokter gigi harus : a. memiliki surat tanda registrasi dokter atau surat tanda registrasi dokter gigi yang masih berlaku sebagaimana dimaksud dalam Pasal 29, Pasal 31, dan Pasal 32; b. mempunyai tempat praktik; dan c. memiliki rekomendasi dari organisasi profesi. (2) Surat izin praktik masih tetap berlaku sepanjang : a. surat tanda registrasi dokter atau surat tanda registrasi dokter gigi masih berlaku; dan b. tempat praktik masih sesuai dengan yang tercantum dalam surat izin praktik. (3) Ketentuan lebih lanjut mengenai surat izin praktik diatur dengan Peraturan Menteri. 14<br />Bagian Kedua<br />Pelaksanaan Praktik<br />Pasal 39 Praktik kedokteran diselenggarakan berdasarkan pada kesepakatan antara dokter atau dokter gigi dengan pasien dalam upaya untuk pemeliharaan kesehatan, pencegahan penyakit, peningkatan kesehatan, pengobatan penyakit dan pemulihan kesehatan.<br />Pasal 40<br />(1) Dokter atau dokter gigi yang berhalangan menyelenggarakan praktik kedokteran harus membuat pemberitahuan atau menunjuk dokter atau dokter gigi pengganti. (2) Dokter atau dokter gigi pengganti sebagaimana dimaksud pada ayat (1) harus dokter atau dokter gigi yang mempunyai surat izin praktik. Pasal 41<br />(1) Dokter atau dokter gigi yang telah mempunyai surat izin praktik dan menyelenggarakan praktik kedokteran sebagaimana dimaksud dalam Pasal 36 wajib memasang papan nama praktik kedokteran. (2) Dalam hal dokter atau dokter gigi berpraktik di sarana pelayanan kesehatan, pimpinan sarana pelayanan kesehatan wajib membuat daftar dokter atau dokter gigi yang melakukan praktik kedokteran. Pasal 42 Pimpinan sarana pelayanan kesehatan dilarang mengizinkan dokter atau dokter gigi yang tidak memiliki surat izin praktik untuk melakukan praktik kedokteran di sarana pelayanan kesehatan tersebut.<br />Pasal 43 Ketentuan lebih lanjut mengenai pelaksanaan praktik kedokteran diatur dengan Peraturan Menteri.<br />Bagian Ketiga<br />Pemberian Pelayanan<br />Paragraf 1<br />Standar Pelayanan<br />Pasal 44<br />(1) Dokter atau dokter gigi dalam menyelenggarakan praktik kedokteran wajib mengikuti standar pelayanan kedokteran atau kedokteran gigi. (2) Standar pelayanan sebagaimana dimaksud pada ayat (1) dibedakan menurut jenis dan strata sarana pelayanan kesehatan. 15<br />(3) Standar pelayanan untuk dokter atau dokter gigi sebagaimana dimaksud pada ayat (1) dan ayat (2) diatur dengan Peraturan Menteri. Paragraf 2<br />Persetujuan Tindakan Kedokteran atau Kedokteran Gigi<br />Pasal 45<br />(1) Setiap tindakan kedokteran atau kedokteran gigi yang akan dilakukan oleh dokter atau dokter gigi terhadap pasien harus mendapat persetujuan. (2) Persetujuan sebagaimana dimaksud pada ayat (1) diberikan setelah pasien mendapat penjelasan secara lengkap. (3) Penjelasan sebagaimana dimaksud pada ayat (2) sekurang-kurangnya mencakup : a. diagnosis dan tata cara tindakan medis; b. tujuan tindakan medis yang dilakukan; c. alternatif tindakan lain dan risikonya; d. risiko dan komplikasi yang mungkin terjadi; dan e. prognosis terhadap tindakan yang dilakukan. (4) Persetujuan sebagaimana dimaksud pada ayat (2) dapat diberikan baik secara tertulis maupun lisan. (5) Setiap tindakan kedokteran atau kedokteran gigi yang mengandung risiko tinggi harus diberikan dengan persetujuan tertulis yang ditandatangani oleh yang berhak memberikan persetujuan. (6) Ketentuan mengenai tata cara persetujuan tindakan kedokteran atau kedokteran gigi sebagaimana dimaksud pada ayat (1), ayat (2), ayat (3), ayat (4), dan ayat (5) diatur dengan Peraturan Menteri. Paragraf 3<br />Rekam Medis<br />Pasal 46<br />(1) Setiap dokter atau dokter gigi dalam menjalankan praktik kedokteran wajib membuat rekam medis. (2) Rekam medis sebagaimana dimaksud pada ayat (1) harus segera dilengkapi setelah pasien selesai menerima pelayanan kesehatan. (3) Setiap catatan rekam medis harus dibubuhi nama, waktu, dan tanda tangan petugas yang memberikan pelayanan atau tindakan. 16<br />Pasal 47<br />(1) Dokumen rekam medis sebagaimana dimaksud dalam Pasal 46 merupakan milik dokter, dokter gigi, atau sarana pelayanan kesehatan, sedangkan isi rekam medis merupakan milik pasien. (2) Rekam medis sebagaimana dimaksud pada ayat (1) harus disimpan dan dijaga kerahasiaannya oleh dokter atau dokter gigi dan pimpinan sarana pelayanan kesehatan. (3) Ketentuan mengenai rekam medis sebagaimana dimaksud pada ayat (1) dan ayat (2) diatur dengan Peraturan Menteri. Paragraf 4<br />Rahasia Kedokteran<br />Pasal 48<br />(1) Setiap dokter atau dokter gigi dalam melaksanakan praktik kedokteran wajib menyimpan rahasia kedokteran. (2) Rahasia kedokteran dapat dibuka hanya untuk kepentingan kesehatan pasien, memenuhi permintaan aparatur penegak hukum dalam rangka penegakan hukum, permintaan pasien sendiri, atau berdasarkan ketentuan perundangundangan. (3) Ketentuan lebih lanjut mengenai rahasia kedokteran diatur dengan Peraturan Menteri. Paragraf 5<br />Kendali Mutu dan Kendali Biaya<br />Pasal 49<br />(1) Setiap dokter atau dokter gigi dalam melaksanakan praktik kedokteran atau kedokteran gigi wajib menyelenggarakan kendali mutu dan kendali biaya. (2) Dalam rangka pelaksanaan kegiatan sebagaimana dimaksud pada ayat (1) dapat diselenggarakan audit medis. (3) Pembinaan dan pengawasan ketentuan sebagaimana dimaksud pada ayat (1) dan ayat (2) dilaksanakan oleh organisasi profesi. Paragraf 6<br />Hak dan Kewajiban Dokter atau Dokter Gigi<br />Pasal 50 Dokter atau dokter gigi dalam melaksanakan praktik kedokteran mempunyai hak :<br />a. memperoleh perlindungan hukum sepanjang melaksanakan tugas sesuai dengan standar profesi dan standar prosedur operasional; b. memberikan pelayanan medis menurut standar profesi dan standar prosedur operasional;<br />17<br />c. d. memperoleh informasi yang lengkap dan jujur dari pasien atau keluarganya; dan menerima imbalan jasa. Pasal 51<br />Dokter atau dokter gigi dalam melaksanakan praktik kedokteran mempunyai kewajiban :<br />a. memberikan pelayanan medis sesuai dengan standar profesi dan standar prosedur operasional serta kebutuhan medis pasien; b. merujuk pasien ke dokter atau dokter gigi lain yang mempunyai keahlian atau kemampuan yang lebih baik, apabila tidak mampu melakukan suatu pemeriksaan atau pengobatan; c. merahasiakan segala sesuatu yang diketahuinya tentang pasien, bahkan juga setelah pasien itu meninggal dunia; d. melakukan pertolongan darurat atas dasar perikemanusiaan, kecuali bila ia yakin ada orang lain yang bertugas dan mampu melakukannya; dan e. menambah ilmu pengetahuan dan mengikuti perkembangan ilmu kedokteran atau kedokteran gigi. Paragraf 7<br />Hak dan Kewajiban Pasien<br />Pasal 52 Pasien, dalam menerima pelayanan pada praktik kedokteran, mempunyai hak:<br />a. mendapatkan penjelasan secara lengkap tentang tindakan medis sebagaimana dimaksud dalam Pasal 45 ayat (3); b. meminta pendapat dokter atau dokter gigi lain; c. mendapatkan pelayanan sesuai dengan kebutuhan medis; d. menolak tindakan medis; dan e. mendapatkan isi rekam medis. Pasal 53 Pasien, dalam menerima pelayanan pada praktik kedokteran, mempunyai kewajiban :<br />a. memberikan informasi yang lengkap dan jujur tentang masalah kesehatannya; b. mematuhi nasihat dan petunjuk dokter atau dokter gigi; c. mematuhi ketentuan yang berlaku di sarana pelayanan kesehatan; dan d. memberikan imbalan jasa atas pelayanan yang diterima. Paragraf 8<br />Pembinaan<br />Pasal 54<br />(1) Dalam rangka terselenggaranya praktik kedokteran yang bermutu dan melindungi masyarakat sesuai dengan ketentuan sebagaimana dimaksud dalam Undang-Undang ini, perlu dilakukan pembinaan terhadap dokter atau dokter gigi yang melakukan praktik kedokteran. 18<br />(2) Pembinaan sebagaimana dimaksud pada ayat (1) dilakukan oleh Konsil Kedokteran Indonesia bersama-sama dengan organisasi profesi. <br /><br />BAB VIII DISIPLIN DOKTER DAN DOKTER GIGI <br />Bagian Kesatu<br />Majelis Kehormatan Disiplin Kedokteran Indonesia<br />Pasal 55<br />(1) Untuk menegakkan disiplin dokter dan dokter gigi dalam penyelenggaraan praktik kedokteran, dibentuk Majelis Kehormatan Disiplin Kedokteran Indonesia. (2) Majelis Kehormatan Disiplin Kedokteran Indonesia merupakan lembaga otonom dari Konsil Kedokteran Indonesia. (3) Majelis Kehormatan Disiplin Kedokteran Indonesia dalam menjalankan tugasnya bersifat independen. Pasal 56 Majelis Kehormatan Disiplin Kedokteran Indonesia bertanggung jawab kepada Konsil Kedokteran Indonesia.<br />Pasal 57<br />(1) Majelis Kehormatan Disiplin Kedokteran Indonesia berkedudukan di ibu kota negara Republik Indonesia. (2) Majelis Kehormatan Disiplin Kedokteran di tingkat provinsi dapat dibentuk oleh Konsil Kedokteran Indonesia atas usul Majelis Kehormatan Disiplin Kedokteran Indonesia. Pasal 58 Pimpinan Majelis Kehormatan Disiplin Kedokteran Indonesia terdiri atas seorang ketua, seorang wakil ketua, dan seorang sekretaris.<br />Pasal 59<br />(1) Keanggotaan Majelis Kehormatan Disiplin Kedokteran Indonesia terdiri atas 3 (tiga) orang dokter dan 3 (tiga) orang dokter gigi dari organisasi profesi masing-masing, seorang dokter dan seorang dokter gigi mewakili asosiasi rumah sakit, dan 3 (tiga) orang sarjana hukum. (2) Untuk dapat diangkat sebagai anggota Majelis Kehormatan Disiplin Kedokteran Indonesia harus dipenuhi syarat sebagai berikut : a. warga negara Republik Indonesia; b. sehat jasmani dan rohani; 19<br />c. bertakwa kepada Tuhan Yang Maha Esa dan berakhlak mulia; d. berkelakuan baik; e. berusia paling rendah 40 (empat puluh) tahun dan paling tinggi 65 (enam puluh lima) tahun pada saat diangkat; f. bagi dokter atau dokter gigi, pernah melakukan praktik kedokteran paling sedikit 10 (sepuluh) tahun dan memiliki surat tanda registrasi dokter atau surat tanda registrasi dokter gigi; g. bagi sarjana hukum, pernah melakukan praktik di bidang hukum paling sedikit 10 (sepuluh) tahun dan memiliki pengetahuan di bidang hukum kesehatan; dan h. cakap, jujur, memiliki moral, etika, dan integritas yang tinggi serta memiliki reputasi yang baik.<br />Pasal 60 Anggota Majelis Kehormatan Disiplin Kedokteran Indonesia ditetapkan oleh Menteri atas usul organisasi profesi.<br />Pasal 61 Masa bakti keanggotaan Majelis Kehormatan Disiplin Kedokteran Indonesia sebagaimana dimaksud dalam Pasal 60 adalah 5 (lima) tahun dan dapat diangkat kembali untuk 1 (satu) kali masa jabatan.<br />Pasal 62<br />(1) Anggota Majelis Kehormatan Disiplin Kedokteran Indonesia sebelum memangku jabatan wajib mengucapkan sumpah/janji sesuai dengan agama masing-masing di hadapan Ketua Konsil Kedokteran Indonesia. (2) Sumpah/janji sebagaimana dimaksud pada ayat (1) berbunyi sebagai berikut : ?Saya bersumpah/berjanji dengan sungguh-sungguh bahwa saya untuk melaksanakan tugas ini, langsung atau tidak langsung, dengan menggunakan nama atau cara apapun juga, tidak memberikan atau menjanjikan sesuatu apapun kepada siapapun juga.<br />Saya bersumpah/berjanji bahwa saya, untuk melakukan atau tidak melakukan sesuatu dalam tugas ini, tidak sekali-kali akan menerima langsung atau tidak langsung dari siapapun juga suatu janji atau pemberian.<br />Saya bersumpah/berjanji bahwa saya dalam menjalankan tugas ini, senantiasa menjunjung tinggi ilmu kedokteran atau kedokteran gigi dan mempertahankan serta meningkatkan mutu pelayanan dokter atau dokter gigi.<br />Saya bersumpah/berjanji bahwa saya akan setia dan taat kepada dan akan mempertahankan serta mengamalkan Pancasila sebagai dasar negara, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, serta peraturan perundang-undangan yang berlaku bagi Negara Republik Indonesia.<br />20<br />Saya bersumpah/berjanji bahwa saya senantiasa akan menjalankan tugas dan wewenang saya ini dengan sungguh-sungguh saksama, obyektif, jujur, berani, adil, tidak membeda-bedakan jabatan, suku, agama, ras, jender, dan golongan tertentu dan akan melaksanakan kewajiban saya dengan sebaikbaiknya, serta bertanggung jawab sepenuhnya kepada Tuhan Yang Maha Esa, masyarakat, bangsa dan negara.<br />Saya bersumpah/berjanji bahwa saya senantiasa akan menolak atau tidak menerima atau tidak mau dipengaruhi oleh campur tangan siapapun juga dan saya akan tetap teguh melaksanakan tugas dan wewenang saya yang diamanatkan Undang-Undang kepada saya ?.<br />Pasal 63<br />(1) Pimpinan Majelis Kehormatan Disiplin Kedokteran Indonesia dipilih dan ditetapkan oleh rapat pleno anggota. (2) Ketentuan lebih lanjut mengenai tata cara pemilihan pimpinan Majelis Kehormatan Disiplin Kedokteran Indonesia diatur dengan Peraturan Konsil Kedokteran Indonesia. Pasal 64 Majelis Kehormatan Disiplin Kedokteran Indonesia bertugas :<br />a. b. menerima pengaduan, memeriksa, dan memutuskan kasus disiplin dokter dan dokter gigi yang diajukan; dan menyusun pedoman dan tata cara penanganan kasus pelangdokter atau dokter gigi. pelanggaran garan disiplin Pasal 65<br />Segala pembiayaan kegiatan Majelis Kehormatan Disiplin Kedokteran Indonesia dibebankan kepada anggaran Konsil Kedokteran Indonesia.<br />Bagian Kedua<br />Pengaduan<br />Pasal 66<br />(1) Setiap orang yang mengetahui atau kepentingannya dirugikan atas tindakan dokter atau dokter gigi dalam menjalankan praktik kedokteran dapat mengadukan secara tertulis kepada Ketua Majelis Kehormatan Disiplin Kedokteran Indonesia. (2) Pengaduan sekurang-kurangnya harus memuat : a. identitas pengadu; b. nama dan alamat tempat praktik dokter atau dokter gigi dan waktu tindakan dilakukan; dan c. alasan pengaduan. 21<br />(3) Pengaduan sebagaimana dimaksud pada ayat (1) dan ayat (2) tidak menghilangkan hak setiap orang untuk melaporkan adanya dugaan tindak pidana kepada pihak yang berwenang dan/atau menggugat kerugian perdata ke pengadilan. Bagian Ketiga<br />Pemeriksaan<br />Pasal 67 Majelis Kehormatan Disiplin Kedokteran Indonesia memeriksa dan memberikan keputusan terhadap pengaduan yang berkaitan dengan disiplin dokter dan dokter gigi.<br />Pasal 68 Apabila dalam pemeriksaan ditemukan pelanggaran etika, Majelis Kehormatan Disiplin Kedokteran Indonesia meneruskan pengaduan pada organisasi profesi.<br />Bagian Keempat<br />Keputusan<br />Pasal 69<br />(1) Keputusan Majelis Kehormatan Disiplin Kedokteran Indonesia mengikat dokter, dokter gigi, dan Konsil Kedokteran Indonesia. (2) Keputusan sebagaimana dimaksud pada ayat (1 ) dapat berupa dinyatakan tidak bersalah atau pemberian sanksi disiplin. (3) Sanksi disiplin sebagaimana dimaksud pada ayat (2) dapat berupa : a. pemberian peringatan tertulis; b. rekomendasi pencabutan surat tanda registrasi atau surat izin praktik; dan/atau<br />c. kewajiban mengikuti pendidikan atau pelatihan di institusi pendidikan kedokteran atau kedokteran gigi. Bagian Kelima<br />Pengaturan Lebih Lanjut<br />Pasal 70 Ketentuan lebih lanjut mengenai pelaksanaan fungsi dan tugas Majelis Kehormatan Disiplin Kedokteran Indonesia, tata cara penanganan kasus, tata cara pengaduan, dan tata cara pemeriksaan serta pemberian keputusan diatur dengan Peraturan Konsil Kedokteran Indonesia.<br /><br />BAB IX PEMBINAAN DAN PENGAWASAN<br />Pasal 71 Pemerintah pusat, Konsil Kedokteran Indonesia, pemerintah daerah, organisasi profesi membina serta mengawasi praktik kedokteran sesuai dengan fungsi dan tugas masing-masing.<br />Pasal 72 Pembinaan dan pengawasan sebagaimana dimaksud dalam Pasal 71 diarahkan untuk :<br />a. meningkatkan mutu pelayanan kesehatan yang diberikan dokter dan dokter gigi; b. melindungi masyarakat atas tindakan yang dilakukan dokter dan dokter gigi; dan c. memberikan kepastian hukum bagi masyarakat, dokter, dan dokter gigi. Pasal 73<br />(1) Setiap orang dilarang menggunakan identitas berupa gelar atau bentuk lain yang menimbulkan kesan bagi masyarakat seolah-olah yang bersangkutan adalah dokter atau dokter gigi yang telah memiliki surat tanda registrasi dan/atau surat izin praktik. (2) Setiap orang dilarang menggunakan alat, metode atau cara lain dalam memberikan pelayanan kepada masyarakat yang menimbulkan kesan seolaholah yang bersangkutan adalah dokter atau dokter gigi yang telah memiliki surat tanda registrasi dan/atau surat izin praktik. (3) Ketentuan sebagaimana dimaksud pada ayat (1) dan ayat (2) tidak berlaku bagi tenaga kesehatan yang diberi kewenangan oleh peraturan perundangundangan. Pasal 74 Dalam rangka pembinaan dan pengawasan dokter dan dokter gigi yang menyelenggarakan praktik kedokteran dapat dilakukan audit medis.<br /><br />BAB X KETENTUAN PIDANA<br />Pasal 75<br />(1) Setiap dokter atau dokter gigi yang dengan sengaja melakukan praktik kedokteran tanpa memiliki surat tanda registrasi sebagaimana dimaksud dalam Pasal 29 ayat (1) dipidana dengan pidana penjara paling lama 3 (tiga) tahun atau denda paling banyak Rp100.000.000,00 (seratus juta rupiah). 23<br />(2) Setiap dokter atau dokter gigi warga negara asing yang dengan sengaja melakukan praktik kedokteran tanpa memiliki surat tanda registrasi sementara sebagaimana dimaksud dalam Pasal 31 ayat (1) dipidana dengan pidana penjara paling lama 3 (tiga) tahun atau denda paling banyak Rp100.000.000,00 (seratus juta rupiah). (3) Setiap dokter atau dokter gigi warga negara asing yang dengan sengaja melakukan praktik kedokteran tanpa memiliki surat tanda registrasi bersyarat sebagaimana dimaksud dalam Pasal 32 ayat (1) dipidana dengan pidana penjara paling lama 3 (tiga) tahun atau denda paling banyak Rp100.000.000,00 (seratus juta rupiah). Pasal 76 Setiap dokter atau dokter gigi yang dengan sengaja melakukan praktik kedokteran tanpa memiliki surat izin praktik sebagaimana dimaksud dalam Pasal 36 dipidana dengan pidana penjara paling lama 3 (tiga) tahun atau denda paling banyak Rp100.000.000,00 (seratus juta rupiah).<br />Pasal 77 Setiap orang yang dengan sengaja menggunakan identitas berupa gelar atau bentuk lain yang menimbulkan kesan bagi masyarakat seolah-olah yang bersangkutan adalah dokter atau dokter gigi yang telah memiliki surat tanda registrasi dokter atau surat tanda registrasi dokter gigi dan/atau surat izin praktik sebagaimana dimaksud dalam Pasal 73 ayat (1) dipidana dengan pidana penjara paling lama 5 (lima) tahun atau denda paling banyak Rp150.000.000,00 (seratus lima puluh juta rupiah).<br />Pasal 78 Setiap orang yang dengan sengaja menggunakan alat, metode atau cara lain dalam memberikan pelayanan kepada masyarakat yang menimbulkan kesan seolah-olah yang bersangkutan adalah dokter atau dokter gigi yang telah memiliki surat tanda registrasi dokter atau surat tanda registrasi dokter gigi atau surat izin praktik sebagaimana dimaksud dalam Pasal 73 ayat (2) dipidana dengan pidana penjara paling lama 5 (lima) tahun atau denda paling banyak Rp150.000.000,00 (seratus lima puluh juta rupiah).<br />Pasal 79 Dipidana dengan pidana kurungan paling lama 1 (satu) tahun atau denda paling banyak Rp50.000.000,00 (lima puluh juta rupiah), setiap dokter atau dokter gigi yang :<br />a. dengan sengaja tidak memasang papan nama sebagaimana dimaksud dalam Pasal 41 ayat (1); b. dengan sengaja tidak membuat rekam medis sebagaimana dimaksud dalam Pasal 46 ayat (1); atau c. dengan sengaja tidak memenuhi kewajiban sebagaimana dimaksud dalam Pasal 51 huruf a, huruf b, huruf c, huruf d, atau huruf e. 24<br />Pasal 80<br />(1) Setiap orang yang dengan sengaja mempekerjakan dokter atau dokter gigi sebagaimana dimaksud dalam Pasal 42, dipidana dengan pidana penjara paling lama 10 (sepuluh) tahun atau denda paling banyak Rp300.000.000,00 (tiga ratus juta rupiah). (2) Dalam hal tindak pidana sebagaimana dimaksud pada ayat (1) dilakukan oleh korporasi, maka pidana yang dijatuhkan adalah pidana denda sebagaimana dimaksud pada ayat (1) ditambah sepertiga atau dijatuhi hukuman tambahan berupa pencabutan izin. BAB XI KETENTUAN PERALIHAN<br />Pasal 81 Pada saat diundangkannya Undang-Undang ini semua peraturan perundangundangan yang merupakan pelaksanaan Undang-Undang Nomor 23 Tahun 1992 tentang Kesehatan yang berkaitan dengan pelaksanaan praktik kedokteran, masih tetap berlaku sepanjang tidak bertentangan dan/atau belum diganti berdasarkan Undang-Undang ini.<br />Pasal 82<br />(1) Dokter dan dokter gigi yang telah memiliki surat penugasan dan/atau surat izin praktik, dinyatakan telah memiliki surat tanda registrasi dan surat izin praktik berdasarkan Undang-Undang ini. (2) Surat penugasan dan surat izin praktik sebagaimana dimaksud pada ayat (1) harus disesuaikan dengan surat tanda registrasi dokter, surat tanda registrasi dokter gigi, dan surat izin praktik berdasarkan Undang-Undang ini paling lama 2 (dua) tahun setelah Konsil Kedokteran Indonesia terbentuk. Pasal 83<br />(1) Pengaduan atas adanya dugaan pelanggaran disiplin pada saat belum terbentuknya Majelis Kehormatan Disiplin Kedokteran Indonesia ditangani oleh Kepala Dinas Kesehatan Provinsi di Tingkat Pertama dan Menteri pada Tingkat Banding. (2) Kepala Dinas Kesehatan Provinsi dan Menteri dalam menangani pengaduan sebagaimana dimaksud pada ayat (1) membentuk Tim yang terdiri dari unsurunsur profesi untuk memberikan pertimbangan. (3) Putusan berdasarkan pertimbangan Tim dilakukan oleh Kepala Dinas Kesehatan Provinsi atau Menteri sesuai dengan fungsi dan tugasnya. Pasal 84<br />(1) Untuk pertama kali anggota Konsil Kedokteran Indonesia diusulkan oleh Menteri dan diangkat oleh Presiden. 25<br />(2) Keanggotaan Konsil Kedokteran Indonesia sebagaimana dimaksud pada ayat (1) berlaku untuk masa jabatan 3 (tiga) tahun sejak diangkat. BAB XII KETENTUAN PENUTUP<br />Pasal 85 Dengan disahkannya Undang-Undang ini maka Pasal 54 Undang-Undang Nomor 23 Tahun 1992 tentang Kesehatan yang berkaitan dengan dokter dan dokter gigi, dinyatakan tidak berlaku lagi.<br />Pasal 86 Konsil Kedokteran Indonesia sebagaimana dimaksud dalam Pasal 84 ayat (2) harus dibentuk paling lama 6 (enam) bulan sejak Undang-Undang ini diundangkan.<br />Pasal 87 Konsil Kedokteran Indonesia sebagaimana dimaksud dalam Pasal 4 harus dibentuk paling lambat 1 (satu) bulan sebelum masa jabatan keanggotaan Konsil Kedokteran Indonesia sebagaimana dimaksud dalam Pasal 84 ayat (2) berakhir.<br />Pasal 88 Undang-Undang ini mulai berlaku 1 (satu) tahun sejak tanggal diundangkan.<br />Agar setiap orang mengetahuinya, memerintahkan pengundangan Undang-Undang ini dengan penempatannya dalam Lembaran Negara Republik Indonesia.<br />Disahkan di Jakarta pada tanggal 6 Oktober 2004<br />PRESIDEN REPUBLIK INDONESIA,<br />ttd.<br />MEGAWATI SOEKARNOPUTRI Diundangkan di Jakarta pada tanggal 6 Oktober 2004<br />SEKRETARIS NEGARA REPUBLIK INDONESIA,<br />ttd.<br />BAMBANG KESOWO<br />LEMBARAN NEGARA REPUBLIK INDONESIA TAHUN 2004 NOMOR 116<br /><br /><br />PENJELASAN ATAS UNDANG-UNDANG REPUBLIK INDONESIA NOMOR 29 TAHUN 2004<br />TENTANG<br />PRAKTIK KEDOKTERAN<br />I. UMUM Pembangunan bidang kesehatan pada dasarnya ditujukan untuk meningkatkan kesadaran, kemauan dan kemampuan hidup sehat bagi setiap orang untuk mewujudkan derajat kesehatan yang optimal sebagai salah satu unsur kesejahteraan sebagaimana diamanatkan oleh Pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945.<br />Dokter dan dokter gigi sebagai salah satu komponen utama pemberi pelayanan kesehatan kepada masyarakat mempunyai peranan yang sangat penting karena terkait langsung dengan pemberian pelayanan kesehatan dan mutu pelayanan yang diberikan.<br />Landasan utama bagi dokter dan dokter gigi untuk dapat melakukan tindakan medis terhadap orang lain adalah ilmu pengetahuan, teknologi, dan kompetensi yang dimiliki, yang diperoleh melalui pendidikan dan pelatihan. Pengetahuan yang dimilikinya harus terus menerus dipertahankan dan ditingkatkan sesuai dengan kemajuan ilmu pengetahuan dan teknologi itu sendiri.<br />Dokter dan dokter gigi dengan perangkat keilmuan yang dimilikinya mempunyai karakteristik yang khas. Kekhasannya ini terlihat dari pembenaran yang diberikan oleh hukum yaitu diperkenankannya melakukan tindakan medis terhadap tubuh manusia dalam upaya memelihara dan meningkatkan derajat kesehatan. Tindakan medis terhadap tubuh manusia yang dilakukan bukan oleh dokter atau dokter gigi dapat digolongkan sebagai tindak pidana.<br />Berkurangnya kepercayaan masyarakat terhadap dokter dan dokter gigi, maraknya tuntutan hukum yang diajukan masyarakat dewasa ini seringkali diidentikkan dengan kegagalan upaya penyembuhan yang dilakukan dokter dan dokter gigi. Sebaliknya apabila tindakan medis yang dilakukan dapat berhasil, dianggap berlebihan, padahal dokter dan dokter gigi dengan perangkat ilmu pengetahuan dan teknologi yang dimilikinya hanya berupaya untuk menyembuhkan, dan kegagalan penerapan ilmu kedokteran dan kedokteran gigi tidak selalu identik dengan kegagalan dalam tindakan.<br />2<br />Berbagai upaya hukum yang dilakukan dalam memberikan perlindungan menyeluruh kepada masyarakat sebagai penerima pelayanan, dokter dan dokter gigi sebagai pemberi pelayanan telah banyak dilakukan, akan tetapi kemajuan ilmu pengetahuan dan teknologi kedokteran yang berkembang sangat cepat tidak seimbang dengan perkembangan hukum.<br />Perangkat hukum yang mengatur penyelenggaraan praktik kedokteran dan kedokteran gigi dirasakan belum memadai, selama ini masih didominasi oleh kebutuhan formal dan kepentingan pemerintah, sedangkan porsi profesi masih sangat kurang.<br />Oleh karena itu untuk menjembatani kepentingan kedua belah pihak serta untuk melakukan penilaian terhadap kemampuan obyektif seorang dokter dan dokter gigi dalam memberikan pelayanan kepada masyarakat, diperlukan pembentukan Konsil Kedokteran Indonesia yang terdiri atas Konsil Kedokteran dan Konsil Kedokteran Gigi.<br />Konsil Kedokteran Indonesia merupakan suatu badan yang independen yang akan menjalankan fungsi regulator, yang terkait dengan peningkatan kemampuan dokter dan dokter gigi dalam pelaksanaan praktik kedokteran. Disamping itu, peran dari berbagai organisasi profesi, asosiasi institusi pendidikan yang ada saat ini juga perlu diberdayakan dalam rangka peningkatan mutu pelayanan kesehatan yang diberikan oleh dokter atau dokter gigi.<br />Dengan demikian, dokter dan dokter gigi dalam menjalankan praktik kedokteran selain tunduk pada ketentuan hukum yang berlaku, juga harus menaati ketentuan kode etik yang disusun oleh organisasi profesi dan didasarkan pada disiplin ilmu kedokteran atau kedokteran gigi.<br />Dalam menjalankan fungsinya Konsil Kedokteran Indonesia bertugas melakukan registrasi terhadap semua dokter dan dokter gigi yang akan menjalankan praktik kedokteran, mengesahkan standar pendidikan profesi dokter dan dokter gigi, dan melakukan pembinaan bersama lembaga terkait lainnya terhadap penyelenggaraan praktik kedokteran.<br />Dalam rangka memberikan kepastian hukum dan perlindungan hukum, untuk meningkatkan, mengarahkan dan memberi landasan hukum serta menata kembali berbagai perangkat hukum yang mengatur penyelenggaraan praktik kedokteran agar dapat berjalan sesuai dengan perkembangan ilmu pengetahuan dan teknologi maka perlu diatur praktik kedokteran dalam suatu undang-undang. Untuk itu, perlu dibentuk Undang-Undang tentang Praktik Kedokteran.<br />3<br />Dalam Undang-Undang ini diatur:<br />1. asas dan tujuan penyelenggaraan praktik kedokteran yang menjadi landasan yang didasarkan pada nilai ilmiah, manfaat, keadilan, kemanusiaan, keseimbangan serta perlindungan dan keselamatan pasien; 2. pembentukan Konsil Kedokteran Indonesia yang terdiri atas Konsil Kedokteran dan Konsil Kedokteran Gigi disertai susunan organisasi, fungsi, tugas, dan kewenangan; 3. registrasi dokter dan dokter gigi; 4. penyusunan, penetapan, dan pengesahan standar pendidikan profesi dokter dan dokter gigi; 5. penyelenggaraan praktik kedokteran; 6. pembentukan Majelis Kehormatan Disiplin Kedokteran Indonesia; 7. pembinaan dan pengawasan praktik kedokteran; dan 8. pengaturan ketentuan pidana. II. PASAL DEMI PASAL Pasal 1 Cukup jelas.<br />Pasal 2 Dalam ketentuan ini yang dimaksud dengan:<br />a. nilai ilmiah adalah bahwa praktik kedokteran harus didasarkan pada ilmu pengetahuan dan teknologi yang diperoleh baik dalam pendidikan termasuk pendidikan berkelanjutan maupun pengalaman serta etika profesi; b. manfaat adalah bahwa penyelenggaraan praktik kedokteran harus memberikan manfaat yang sebesar-besarnya bagi kemanusiaan dalam rangka mempertahankan dan meningkatkan derajat kesehatan masyarakat; c. keadilan adalah bahwa penyelenggaraan praktik kedokteran harus mampu memberikan pelayanan yang adil dan merata kepada setiap orang dengan biaya yang terjangkau oleh masyarakat serta pelayanan yang bermutu; d. kemanusiaan adalah bahwa dalam penyelenggaraan praktik kedokteran memberikan perlakuan yang sama dengan tidak membedakan suku, bangsa, agama, status sosial, dan ras; e. keseimbangan adalah bahwa dalam penyelenggaraan praktik kedokteran tetap menjaga keserasian serta keselarasan antara kepentingan individu dan masyarakat; f. perlindungan dan keselamatan pasien adalah bahwa penyelenggaraan praktik kedokteran tidak hanya memberikan pelayanan kesehatan semata, tetapi harus mampu memberikan peningkatan derajat kesehatan dengan tetap memperhatikan perlindungan dan keselamatan pasien. 4<br />Pasal 3 Cukup jelas.<br />Pasal 4 Cukup jelas.<br />Pasal 5 Cukup jelas.<br />Pasal 6 Cukup jelas.<br />Pasal 7 Ayat (1) Cukup jelas.<br />Ayat (2) Yang dimaksud dengan “standar pendidikan profesi dokter dan dokter gigi” adalah pendidikan profesi yang dilakukan sesuai dengan peraturan perundang-undangan yang berkaitan dengan sistem pendidikan nasional.<br />Penyusunan standar pendidikan profesi bagi dokter dan dokter gigi dilakukan oleh asosiasi institusi pendidikan kedokteran dan asosiasi institusi pendidikan kedokteran gigi dengan mengikutsertakan kolegium kedokteran, kolegium kedokteran gigi, dan asosiasi rumah sakit pendidikan.<br />Penyusunan standar pendidikan profesi bagi dokter spesialis dan dokter gigi spesialis dilakukan oleh kolegium kedokteran dan kolegium kedokteran gigi dengan mengikutsertakan asosiasi institusi pendidikan kedokteran, asosiasi institusi pendidikan kedokteran gigi dan rumah sakit pendidikan.<br />Konsil Kedokteran Indonesia mengesahkan standar pendidikan profesi dokter, dokter spesialis, dokter gigi dan dokter gigi spesialis yang telah ditetapkan tersebut diatas.<br />Yang dimaksud dengan “asosiasi institusi pendidikan kedokteran” adalah suatu lembaga yang dibentuk oleh para dekan fakultas kedokteran yang berfungsi memberikan pertimbangan dalam rangka memberdayakan dan menjamin kualitas pendidikan kedokteran yang diselenggarakan oleh fakultas kedokteran.<br />Yang dimaksud dengan “asosiasi institusi pendidikan kedokteran gigi” adalah suatu lembaga yang dibentuk oleh para dekan fakultas kedokteran gigi yang berfungsi memberikan pertimbangan dalam rangka memberdayakan dan menjamin kualitas pendidikan kedokteran gigi yang diselenggarakan oleh fakultas kedokteran gigi.<br />5<br />Yang dimaksud dengan “asosiasi rumah sakit pendidikan” adalah himpunan rumah sakit pendidikan dokter atau dokter gigi (teaching hospital).<br />Pasal 8 Huruf a Cukup jelas.<br />Huruf b Cukup jelas.<br />Huruf c Standar kompetensi disusun oleh asosiasi institusi pendidikan kedokteran dan asosiasi institusi pendidikan kedokteran gigi serta kolegium kedokteran dan kolegium kedokteran gigi.<br />Huruf d Cukup jelas.<br />Huruf e Penerapan cabang ilmu kedokteran dan kedokteran gigi yang disahkan, terlebih dahulu ditetapkan bersama kolegium terkait.<br />Huruf f Etika profesi adalah kode etik dokter dan kode etik dokter gigi yang disusun oleh Ikatan Dokter Indonesia (IDI) dan Persatuan Dokter Gigi Indonesia (PDGI).<br />Huruf g Pencatatan dimaksudkan sebagai bahan pertimbangan untuk pemberian surat tanda registrasi dokter dan surat tanda registrasi dokter gigi dalam registrasi ulang.<br />Pasal 9 Cukup jelas.<br />Pasal 10 Cukup jelas.<br />Pasal 11 Cukup jelas.<br />Pasal 12 Cukup jelas.<br />Pasal 13 Cukup jelas.<br />6<br />Pasal 14<br />Ayat (1) Unsur dari asosiasi rumah sakit pendidikan, Departemen Kesehatan dan Departemen Pendidikan Nasional yang masingmasing 2 (dua) orang terdiri atas 1 (satu) orang berlatar belakang pendidikan profesi dokter dan 1 (satu) orang dokter gigi.<br />Yang dimaksud dengan “tokoh masyarakat” adalah orang yang peduli dan mempunyai komitmen tinggi untuk kepentingan pasien. Dengan demikian, Ketua Konsil Kedokteran dan Ketua Konsil Kedokteran Gigi disebut juga registrar.<br />Ayat (3) Huruf a Cukup jelas<br />Huruf b Cukup jelas.<br />Huruf c Surat keterangan sehat fisik dan mental adalah bukti tertulis yang dikeluarkan oleh dokter yang memiliki surat izin praktik.<br />Huruf d Sertifikat kompetensi dikeluarkan oleh kolegium yang bersangkutan.<br />Huruf e Cukup jelas.<br />Ayat (4) Cukup jelas.<br />Ayat (5) Pertimbangan dimaksud dalam ayat ini untuk melihat apakah dokter atau dokter gigi tersebut selama menjalankan praktik kedokteran telah dikenakan sanksi oleh Majelis Kehormatan Etik Kedokteran, Majelis Kehormatan Etik Kedokteran Gigi, Majelis Kehormatan Disiplin Kedokteran Indonesia, atau putusan hakim.<br />Ayat (6) Memelihara dan menjaga registrasi dokter dan dokter gigi dilakukan dengan membuat daftar yang memuat nama dokter atau dokter gigi yang memiliki surat tanda registrasi dokter atau surat tanda registrasi dokter gigi dan hal lain yang terkait dengan ketentuan tentang registrasi dokter atau dokter gigi.<br />9<br />Pasal 30<br />Ayat (1) Evaluasi dilakukan oleh perguruan tinggi di Indonesia berdasarkan permintaan tertulis dari Konsil Kedokteran Indonesia. Konsil Kedokteran Indonesia meminta pengujian setelah dilakukan evaluasi terhadap kesahan ijazah sesuai dengan peraturan perundang-undangan.<br />Ayat (2) Cukup jelas.<br />Ayat (3) Yang dimaksud dengan “peraturan perundang-undangan” adalah peraturan perundang-undangan di bidang ketenagakerjaan dan keimigrasian.<br />Ayat (4) Cukup jelas.<br />Pasal 31<br />Ayat (1) Yang dimaksud dengan “surat tanda registrasi sementara dokter dan dokter gigi” adalah bukti tertulis yang diberikan oleh Konsil Kedokteran dan Konsil Kedokteran Gigi kepada dokter dan dokter gigi warga negara asing yang melakukan kegiatan di bidang kedokteran.<br />Ayat (2) Cukup jelas.<br />Ayat (3) Cukup jelas.<br />Pasal 32<br />Ayat (1) Yang dimaksud dengan “surat tanda registrasi bersyarat dokter dan dokter gigi” adalah bukti tertulis yang diberikan oleh Konsil Kedokteran dan Konsil Kedokteran Gigi kepada peserta didik untuk mengikuti pendidikan dan pelatihan kedokteran atau kedokteran gigi di Indonesia bagi dokter atau dokter gigi warga negara asing.<br />Ayat (2) Cukup jelas.<br />Ayat (3) Cukup jelas.<br />10<br />Ayat (4) Cukup jelas.<br />Pasal 33 Cukup jelas.<br />Pasal 34 Cukup jelas.<br />Pasal 35 Ayat (1) Huruf a Cukup jelas. Namun, apabila pasien yang bersangkutan berada di bawah pengampuan (under curatele) persetujuan atau penolakan tindakan medis dapat diberikan oleh keluarga terdekat antara lain suami/istri, ayah/ibu kandung, anak-anak kandung atau saudarasaudara kandung.<br />Dalam keadaan gawat darurat, untuk menyelamatkan jiwa pasien tidak diperlukan persetujuan. Namun, setelah pasien sadar atau dalam kondisi yang sudah memungkinkan, segera diberikan penjelasan dan dibuat persetujuan.<br />Dalam hal pasien adalah anak-anak atau orang yang tidak sadar, maka penjelasan diberikan kepada keluarganya atau yang mengantar. Apabila tidak ada yang mengantar dan tidak ada keluarganya sedangkan tindakan medis harus dilakukan maka penjelasan diberikan kepada anak yang bersangkutan atau pada kesempatan pertama pasien sudah sadar.<br />Ayat (2) Cukup jelas.<br />Ayat (3) Penjelasan hendaknya diberikan dalam bahasa yang mudah dimengerti karena penjelasan merupakan landasan untuk memberikan persetujuan. Aspek lain yang juga sebaiknya diberikan penjelasan yaitu yang berkaitan dengan pembiayaan.<br />Ayat (4) Persetujuan lisan dalam ayat ini adalah persetujuan yang diberikan dalam bentuk ucapan setuju atau bentuk gerakan menganggukkan kepala yang diartikan sebagai ucapan setuju.<br />Ayat (5) Yang dimaksud dengan “tindakan medis berisiko tinggi” adalah seperti tindakan bedah atau tindakan invasif lainnya.<br />Ayat (6) Cukup jelas.<br />13<br />Pasal 46<br />Ayat (1) Yang dimaksud dengan “rekam medis” adalah berkas yang berisikan catatan dan dokumen tentang identitas pasien, pemeriksaan, pengobatan, tindakan, dan pelayanan lain yang telah diberikan kepada pasien.<br />Ayat (2) Dalam hal terjadi kesalahan dalam melakukan pencatatan pada rekam medis, berkas dan catatan tidak boleh dihilangkan atau dihapus dengan cara apa pun. Perubahan catatan atau kesalahan dalam rekam medis hanya dapat dilakukan dengan pencoretan dan dibubuhi paraf petugas yang bersangkutan.<br />Ayat (3) Yang dimaksud dengan “petugas” adalah dokter atau dokter gigi atau tenaga kesehatan lain yang memberikan pelayanan langsung kepada pasien. Apabila dalam pencatatan rekam medis menggunakan teknologi informasi elektronik, kewajiban membubuhi tanda tangan dapat diganti dengan menggunakan nomor identitas pribadi (personal identification number).<br />Pasal 47 Cukup jelas.<br />Pasal 48 Cukup jelas.<br />Pasal 49<br />Ayat (1) Yang dimaksud dengan “kendali mutu” adalah suatu sistem pemberian pelayanan yang efisien, efektif, dan berkualitas yang memenuhi kebutuhan pasien. Yang dimaksud dengan “kendali biaya” adalah pembiayaan pelayanan kesehatan yang dibebankan kepada pasien benarbenar sesuai dengan kebutuhan medis pasien didasarkan pola tarif yang ditetapkan berdasarkan peraturan perundangundangan.<br />Ayat (2) Yang dimaksud dengan “audit medis” adalah upaya evaluasi secara profesional terhadap mutu pelayanan medis yang diberikan kepada pasien dengan menggunakan rekam medisnya yang dilaksanakan oleh profesi medis.<br />Ayat (3) Cukup jelas.<br />14<br />Pasal 50<br />Yang dimaksud dengan “standar profesi” adalah batasan kemampuan (knowledge, skill and professional attitude) minimal yang harus dikuasai oleh seorang individu untuk dapat melakukan kegiatan profesionalnya pada masyarakat secara mandiri yang dibuat oleh organisasi profesi.<br />Yang dimaksud dengan “standar prosedur operasional” adalah suatu perangkat instruksi/langkah-langkah yang dibakukan untuk menyelesaikan suatu proses kerja rutin tertentu. Indigenous cultures (e.g., African and Native American) used herbs in their healing rituals, while others developed traditional medical systems (e.g., Ayurveda and Traditional Chinese Medicine) in which herbal therapies were used systematically. Scientists found that people in different parts of the globe tended to use the same or similar plants for the same purposes.<br /><br />In the early 19th century, when methods of chemical analysis first became available, scientists began extracting and modifying the active ingredients from plants. You may be physically examined and asked about your medical history and your general well-being (that is, how well you sleep, what you eat, if you have a good appetite, good digestion and elimination, how often you exercise, and what you do to relax). The herbalist might recommend one or more herbs, dietary changes, and lifestyle modifications. Because herbal medicines are slower acting than pharmaceuticals, you might be asked to return for a follow-up in two to four weeks.<br /><br /><br /><strong>What is herbal medicine good for?<br /></strong>Herbalists treat many conditions such as asthma, eczema, premenstrual syndrome, rheumatoid arthritis, migraine, menopausal symptoms, chronic fatigue, and irritable bowel syndrome, among others. Herbal preparations are best taken under the guidance of a trained professional. Be sure to consult with your doctor or an herbalist before self-treating. Some common herbs and their uses are discussed below. Please see our monographs on individual herbs for detailed descriptions of uses as well as risks, side effects, and potential interactions.<br /><br /></div><ul><li><div align="justify">Ginkgo ( Ginkgo biloba ) , particularly a standardized extract known as EGb 761, appears to produce improvements in awareness, judgment, and social function in people with Alzheimer's disease and dementia. In a year-long study of 309 people with Alzheimer's disease, those taking EGb 761 consistently improved while those on placebo worsened.<br /></div></li><li><div align="justify">Kava kava ( Piper methysticum ) has become popular as a treatment for anxiety, but recent reports have traced liver damage to enough people who have used kava that the U.S. FDA has issued a warning regarding its use and other countries, such as Germany and Canada, have taken kava off of the market.<br /></div></li><li><div align="justify">St. John's wort ( Hypericum perforatum ) is well known for its antidepressant effects, and an analysis of 27 studies involving more than 2,000 people confirmed that the herb is an effective treatment for mild to moderate depression.<br /></div></li><li><div align="justify">Valerian ( Valeriana officinalis ) has had a long tradition as a sleep-inducing agent, with the added benefit of producing no hangover feeling the next day.<br /></div></li><li><div align="justify">Echinacea preparations (from Echinacea purpurea and other Echinacea species) may bolster immunity. In a study of 160 volunteers with flu-like symptoms, echinacea extract reduced both the frequency and severity of cold symptoms. </div></li></ul><strong></strong><div align="justify"><br /><strong>Is there anything I should watch out for?<br /></strong>Used correctly, many herbs are considered safer than conventional medications, but because they are unregulated, herbal products are often mislabeled and may contain undeclared additives and adulterants. Some herbs are associated with allergic reactions or interact with conventional drugs. Self-prescribing herbal products will increase your risk, so it is important to consult your doctor and an herbalist before taking herbal medicines. Some examples of adverse reactions from certain popular herbs are described below.<br /><br /></div><ul><li><div align="justify">St. John's wort causes sensitivity to the sun's ultraviolet rays, and may cause an allergic reaction, stomach upset, fatigue, and restlessness. Studies show that St. John's wort also interferes with the effectiveness of many drugs, including warfarin (a blood thinner), protease inhibitors for HIV, possibly birth control pills, and many other medications. In addition, St. John's wort must not be taken with anti-depressant medication. The Food and Drug Administration (FDA) has issued a public health advisory concerning many of these interactions.<br /></div></li><li><div align="justify">Kava kava and echinacea have both been linked to liver toxicity. Again, kava has been taken off the market in several countries because of the liver toxicity.<br /></div></li><li><div align="justify">Valerian may cause oversedation, and in some people it may even have the unexpected effect of overstimulating instead of sedating.<br /></div></li><li><div align="justify">Feverfew ( Tanacetum parthenium ) may cause agitation.<br /></div></li><li><div align="justify">Bleeding time may be altered with the use of garlic, ginkgo, feverfew, ginger ( Zingiber officinale ) and ginseng. </div></li></ul><p align="justify"></p><p align="justify"><strong>Who is using herbal medicine?<br /></strong>Nearly one-third of Americans use herbs and it is estimated that in 1998 alone $4 billion was spent on herbal products in this country. Unfortunately, a recent study in the New England Journal of Medicine indicated that nearly 70% of individuals taking herbal medicines (the majority of which were well educated and had a higher-than-average income) were reluctant to reveal their use of complementary and alternative medicine to their doctors. Because herbal medicines contain a combination of chemicals, each with a specific action, many are capable of eliciting complex physiological responses—some of which may create unwanted or unexpected results when combined with conventional drugs. Be sure to consult your doctor before trying any herbal products. </p><p align="justify"></p><p align="justify"><strong>How is herbal medicine sold in stores?<br /></strong>The herbs available in most stores come in several different forms: teas, syrups, oils, liquid extracts, tinctures, and dry extracts (pills or capsules). Teas are simply dried herbs left to soak for a few minutes in boiling water. Syrups, made from concentrated extracts and added to sweet-tasting preparations, are frequently used for sore throats and coughs. Oils are extracted from plants and often used as rubs for massage, either alone or as part of an ointment or cream. Tinctures and liquid extracts are solvents (usually water, alcohol, or glycerol) that contain the active ingredients of the herbs. Tinctures are typically a 1:5 or 1:10 concentration, meaning that one part of the herbal material is prepared with five to ten parts (by weight) of the liquid. Liquid extracts are more concentrated than tinctures and are typically a 1:1 concentration. A dry extract form is the most concentrated form of an herbal product (typically 2:1 to 8:1) and is sold as a tablet, capsule, or lozenge. Currently, no organization or government body regulates the manufacture or certifies the labeling of herbal preparations. This means you can't be sure that the amount of the herb contained in the bottle, or even from dose to dose, is the same as what is stated on the label. Some herbal preparations are standardized, meaning that the preparation is guaranteed to contain a specific amount of the active ingredients of the herb. However, it is still important to ask companies that are making standardized herbal products the basis for their product's guarantee. If consumers insist on an answer to this question, manufacturers of these herbal products may begin to implement more quality control processes, like microscopic, chemical, and biological analyses. Again, it is important to consult your doctor or an expert in herbal medicine for the recommended doses of any herbal products you are considering</p><p align="justify"><strong></strong></p><p align="justify"><strong>Are there experts in herbal medicine?<br /></strong>Herbalists, chiropractors, naturopathic physicians, and practitioners of Traditional Chinese Medicine all use herbs to treat illness. Naturopathic physicians believe that the body is continually striving for balance and that natural therapies can be used to support this process. They are trained in four-year, postgraduate institutions that combine courses in conventional medical science (such as pathology, microbiology, pharmacology, and surgery) with clinical training in herbal medicine, homeopathy, nutrition, and lifestyle counseling. </p><p align="justify"></p><p align="justify"><strong>What is the future of herbal medicine?<br /></strong>Although a renaissance is occurring in herbal medicine in the United States, the FDA still classifies herbs as dietary supplements and forbids manufacturers to claim that their products are able to treat or prevent specific diseases. In some countries in Europe, however, herbs are classified as drugs and are regulated. If the heart is not getting enough oxygen, a person may experience pain or discomfort in the chest known as angina, especially during exercise or increased activity. Symptoms of angina include:</div></li></ul><ol><li><div align="justify">A feeling of discomfort or pressure felt in the chest, ranging from a vague ache to a crushing sensation </div></li><li><div align="justify">Pain or pressure in the left arm, shoulder, or throat </div></li><li><div align="justify">Difficulty catching your breath </div></li></ol><p align="justify"><br />CHD is the most common cause of angina. Angina is a sign that the heart muscle is not receiving enough oxygen and nutrients. If you are experiencing any of the symptoms of angina, you should be evaluated by a physician. </p><ul><li><div align="justify"><br /><strong>Heart Failure<br /></strong>Heart failure occurs when a weakened heart cannot pump efficiently, and fluid builds up in the ankles, legs, lungs, and other tissues. The combination of clogged blood vessels and high blood pressure often causes heart failure. </div></li><li><div align="justify"><br /><strong>Heart Attack</strong><br />If blood flow to any part of the heart is completely blocked, the cells in that part of the heart begin to die, causing a heart attack. This drop is partly because more people are eating right and exercising regularly, and partly because of advances in medical care for those who do have heart disease. </div></li><li><div align="justify"><br />One in ten women aged 45 to 64 has some form of heart disease. The rate increases to one in five for women 65 years of age and older. </div></li><li><div align="justify"><br />Close to one-half of Americans with high blood pressure- an important risk factor for heart disease - don't even know they have it. </div></li><li><div align="justify"><br />Heart disease is the leading cause of death in cigarette smokers. </div></li><li><div align="justify"><br />Based on new weight-for-height guidelines, more than one-half of Americans are considered overweight or obese. It is essential for life on Earth and is one of Earth's natural processes. It is the result of heat absorption by certain <a href="http://lwf.ncdc.noaa.gov/oa/climate/gases.html">gases</a> in the atmosphere (called greenhouse gases because they effectively 'trap' heat in the lower atmosphere) and re-radiation downward of some of that heat. <a href="http://lwf.ncdc.noaa.gov/oa/climate/gases.html#wv">Water vapor</a> is the most abundant greenhouse gas, followed by <a title="Carbon Dioxide" href="http://lwf.ncdc.noaa.gov/oa/climate/gases.html#cd">carbon dioxide</a> and other <a href="http://lwf.ncdc.noaa.gov/oa/climate/gases.html">trace gases</a>. The neural tube is a narrow channel that folds and closes between the 3rd and 4th weeks of pregnancy to form the brain and spinal cord of the embryo. Anencephaly occurs when the "cephalic" or head end of the neural tube fails to close, resulting in the absence of a major portion of the brain, skull, and scalp. Infants with this disorder are born without a forebrain (the front part of the brain) and a cerebrum (the thinking and coordinating part of the brain). The remaining brain tissue is often exposed--not covered by bone or skin. A baby born with anencephaly is usually blind, deaf, unconscious, and unable to feel pain. Although some individuals with anencephaly may be born with a rudimentary brain stem, the lack of a functioning cerebrum permanently rules out the possibility of ever gaining consciousness. Reflex actions such as breathing and responses to sound or touch may occur.<br /></div><div align="justify"></div><div align="justify">The cause of anencephaly is unknown. Although it is thought that a mother's diet and vitamin intake may play a role, scientists believe that many other factors are also involved.<br /></div><div align="justify"></div><div align="justify">Recent studies have shown that the addition of folic acid (vitamin B9) to the diet of women of childbearing age may significantly reduce the incidence of neural tube defects. In fact, "cataract" means waterfall in Latin. Why? These pulses move back and forth between nerve cells to produce thoughts, feelings, and memories.</div><br /><br /><br />An epileptic seizure occurs when these energy pulses come much more rapidly-as many as 500 per second for a short time-due to an electrical abnormality in the brain. This brief electrical surge can happen in just a small area of the brain, or it can affect the whole brain. Depending on the part of the brain that is affected, the surge of electrical energy can cause:<br />- Changes in a person's sensations or state of consciousness.<br />- Uncontrolled movements of certain parts of the body or of the whole body.<br /><br /><br /><strong></strong></div><div align="left"><strong>These changes are known as an epileptic seizure.<br /></strong><em>-Epilepsy is also known as a seizure disorder because the tendency is to have recurrent seizures.<br />-Epileptic seizures vary in severity and frequency, and even in the time of day they occur.<br />-While some people may experience no more than two or three seizures during their entire lifetime, others will have several seizures in one day. </em><br /><strong></strong><br /><strong></strong><br /><strong></strong><br /><strong>Does Everyone Who Has A Seizure Have Epilepsy?<br /></strong><strong></strong><br />A seizure is a symptom of epilepsy, but not all seizures are caused by epilepsy.<br /><br />A seizure not related to epilepsy can be caused by a reaction to:<br />- A drug<br />- A high fever<br />- A severe head injury<br />- Other disorders such diabetes, some heart conditions, and narcolepsy , among others.<br /> Sometimes people have a single seizure for which no cause can ever be found.<br /><br /><br /><br />Several conditions or behaviors mimic epilepsy but are not epilepsy.<br />- Epilepsy is not a fainting disorder.<br />- Epilepsy cannot be caused by holding the breath. Some children act out by holding their breath until they faint. This is not epilepsy.<br />- Epilepsy is not momentary confusion, forgetfulness, or a lack of concentration.<br />- Epilepsy is not catatonia, a specific type of schizophrenia characterized by stupor and bizarre movements.<br /><br /><br /><br /><strong>Epilepsy is not contagious. This is a serious situation in which a person has prolonged seizures or does not fully regain consciousness between seizures.<br /><br /><br /></div><div align="left">Some doctors define status epilepticus as a seizure that lasts for more than five minutes. More conservative doctors define the condition as a seizure lasting 10 or even 30 minutes. Without emergency attention, this condition can cause permanent brain damage or be fatal.<br /><br /><br /><br /><br /><br />Hence the importance of taking the medication prescribed.<br /><br />- About a third of status epilepticus events are triggered when a person stops taking antiepileptic medication.<br />- Status epilepticus can by triggered by sudden withdrawal of certain antiepileptic drugs.<br />- About a third of the time, it is the first sign of a seizure disorder. It can also follow stroke, poisoning, high fever, or low blood sugar in people with diabetes.<br /><br /></div><div align="left"> </div><div align="left">Status epilepticus affects over 100,000 people in the United States each year and causes about 50,000 deaths.<br /><br /><br /><br /><strong><em><span style="font-size:130%;color:#ff0000;">Facts About Epilepsy:<br /></span></em>- </strong>About two million people in the United States have epilepsy or have had a seizure at some point in their lives.<br /><strong>-</strong> About 75% of people with epilepsy had their first seizures in childhood.<br /><strong>- </strong>Epilepsy was first mentioned more than 3,000 years ago in ancient Babylon. It occurs rarely in men and it doesn't affect kids. But kids might want to learn about it because they know someone who has it or because they want to learn how to check for it when they are older.<br /><br /><br /><strong>What Is Breast Cancer?<br /></strong><br /><br />The human body is made of tiny building blocks called cells. Your body creates them, replacing those that die with new ones. Usually, the body creates healthy, normal cells that do just what they're supposed to do. This includes cells in the breasts, the two rounded areas on the front of the chest.<br /><br /><br />But if a cell changes into an abnormal, sometimes harmful form, it can divide quickly over and over again without dying, making many, many copies of itself. Someone with breast cancer may have cancer cells in just one part of the breast, which might be felt as a lump. The cancer can spread throughout one or both breasts. If women examine their breasts monthly, they can help find lumps or other changes that a doctor should examine.<br /><br /><br />Most breast lumps are not cancer, but all lumps should be checked out by a doctor to be sure. Breast lumps that are not cancer may be scar tissue or cysts (fluid-filled lumps or sacs) or they can be due to normal breast changes associated with <a href="http://kidshealth.org/kid/word/h/word_hormone.html">hormone</a> changes or aging.<br /><br /><br />Girls who are beginning puberty might notice a lump underneath the nipple when their breasts start developing. Usually, this is a normal. You can ask a parent or your doctor about it to be sure.<br /><br /><br /><strong>What Will the Doctor Do?<br /></strong><br /><br />Sometimes a doctor will discover a lump in a woman's breast during a routine examination or a patient might come to the doctor with questions about a lump she found. In other cases, a mammogram (say: ma-muh-gram) may find a lump in the breast that can't be felt. A mammogram is a special kind of <a href="http://kidshealth.org/kid/word/x/word_xray.html">X-ray</a> of the breast that helps doctors see what's going on inside. Sometimes, other kinds of pictures, like an MRI, can also be taken.<br /><br /><br />When a lump is found, the doctor will want to test it. The best way to do this is usually with a <a href="http://kidshealth.org/kid/word/b/word_biopsy.html">biopsy</a>. In a biopsy, a small amount of breast tissue is removed with a needle or during a small operation. Then, the tissue is examined under a microscope to look for cancer cells.<br />The biopsy may be benign (say: bih-nine), which means the lump is not cancer. If the biopsy shows cancer cells, the lump is malignant (say: muh-lig-nunt). If a breast lump does contains cancer cells, the woman, along with her doctor and family, will decide what to do next.<br /><br /><br /><strong>Breast Cancer Treatment</strong><br /><br /><br />Treatment for breast cancer usually depends on the type of cancer and whether the cancer has spread outside of the breast to the rest of the body.<br /><br /><br /><strong>Here are some common treatments:<br /></strong><br /><br /><strong>lumpectomy (say: lum-pek-tuh-mee),</strong> which removes the cancerous tumor from the breast. A woman usually has this surgery when the cancer is found early and when the lump is small and in only one part of the breast.<br /><br /><br /><strong>mastectomy (say: ma-stek-tuh-mee),</strong> which removes the whole breast. This surgery is done when cancer cells have spread through the breast or into other parts of the body. Chemotherapy (say: kee-mo-ther-uh-pee) is special medicine that travels throughout the entire body and kills cancer cells.<br /><br /><br /><strong>Living With Breast Cancer<br /></strong><br /><br />Dealing with breast cancer can be very hard for a woman and her family. A woman who has breast cancer surgery or treatment may not feel well for a while. She may be depressed if she had her breast removed. If a woman needs chemotherapy, she may lose her hair and she may feel sick to her stomach. She also may worry that the cancer will return and she'll get sick again.<br /><br /><br />The good news is that many times, especially if a lump is caught early, women with breast cancer go on to live full, healthy lives after treatment. Some women join support groups so they can talk to other women with breast cancer who are feeling the same emotions.<br /><br /><br />There are even groups that kids or other family members can join to talk about their feelings when someone they love has breast cancer. Find a trusted adult to <a href="http://kidshealth.org/kid/feeling/thought/talk_feelings.html">talk</a> with if you're worried about a loved one.<br /><br /><br /><strong>Breast Cancer Prevention<br /></strong><br /><br />Doctors and scientists are working on finding cures for all types of breast cancer. It is a condition that permanently affects the brain, and over time, makes it harder to remember even basic stuff, like how to tie a shoe.<br /><br /><br />Eventually, the person may have trouble remembering the names and faces of family members - or even who he or she is. This can be very sad for the person and their families. It's important to know that Alzheimer disease does not affect kids. It usually affects people over 65 years of age. Researchers have found medicines that seem to slow the disease down. And there's hope that someday there will be a cure.<br /><br /><br /><strong>What Happens in the Brain?<br /></strong><br /><br />You probably know that your brain works by sending signals. Chemical messengers, called neurotransmitters (say: nur-oh-trans-mih-terz), allow brain cells to communicate with each other. But a person with Alzheimer disease has decreased amounts of neurotransmitters. People with Alzheimer disease also develop deposits of stuff (protein and fiber) that prevent the cells from working properly. When this happens, the cells can't send the right signals to other parts of the brain. Over time, brain cells affected by Alzheimer disease also begin to shrink and die.<br />Lots of research is being done to find out more about the causes of Alzheimer disease. There is no one reason why people get Alzheimer disease. Older people are more likely to get it, and the risk gets greater the older the person gets. For instance, the risk is higher for someone who is 85 than it is for someone who is 65. And women are more likely to get it than men.<br /><br /><br />Researchers also think <a href="http://kidshealth.org/kid/talk/qa/what_is_gene.html">genes</a> handed down from family members can make a person more likely to get Alzheimer disease. But that doesn't mean everyone related to someone who has Alzheimer disease will get the disease. Other factors, combined with genes, may make it more likely that someone will get the disease. Some of them are high blood pressure, high cholesterol, Down syndrome, or having a head injury.<br /><br /><br />On the positive side, researchers believe exercise, a healthy diet, and taking steps to keep your mind active (like doing crossword puzzles) may help delay the onset of Alzheimer disease.<br /><br /><br /><strong>How Do People Know They Have It?<br /></strong><br /><br />The first sign of Alzheimer disease is a continuous pattern of forgetting things. This starts to affect a person's daily life. He or she may forget where the grocery store is or the names of family and friends. This stage of the disease may last for some time or quickly progress, causing memory loss and forgetfulness to get worse.<br /><br /><br /><strong>What Will the Doctor Do?<br /></strong><br /><br />It can be hard for a doctor to diagnose Alzheimer disease because many of its symptoms (like memory problems) can be like those of other conditions affecting the brain. The doctor will talk to the patient, find out about any medical problems the person has, and will examine him or her.<br />The doctor can ask the person questions or have the person take a written test to see how well his or her memory is working. Doctors also can use medical tests (such as MRI or <a href="http://kidshealth.org/kid/word/word.html#CTScan">CT scans</a>) to take a detailed picture of the brain. They can study these images and look for the deposits of proteins and fiber that are typical of Alzheimer disease.<br /><br /><br />Once a person is diagnosed with Alzheimer disease, the doctor may prescribe medicine to help with memory and thinking. The doctor also might give the person medicine for other problems, such as depression (sad feelings that last a long time). Unfortunately the medicines that the doctors have can't cure Alzheimer disease; they just help slow down the disease.<br /><br /><br /><strong>When Someone You Love Has Alzheimer Disease<br /></strong><br /><br />You might feel sad or angry - or both - if someone you love has Alzheimer disease. You might feel nervous around the person, especially if he or she is having trouble remembering important things or can no longer take care of himself or herself.<br /><br /><br />You might not want to go visit the person, even though your mom or dad wants you to. You are definitely not alone in these feelings. Try talking with a parent or another trusted adult. Just saying what's on your mind may help you feel better. You also may learn that the adults in your life are having struggles of their own with the situation.<br /><br /><br />If you visit a loved one who has Alzheimer disease, try to be patient. He or she may have good days and bad days. It can be sad if you no longer are able to have fun in the same ways together. Maybe you and your grandmother liked to go to concerts. They have certain physical features, such as a flatter face, upward slanting eyes, and a somewhat larger tongue. They may have medical problems, too, such as heart defects. And they usually have some mental retardation, which means they may have trouble learning. But despite their challenges, kids with Down syndrome can go to regular schools, make friends, enjoy life, and get jobs when they're older.<br /><br /><br />To understand why Down syndrome happens, you need to understand a little about chromosomes. What's a chromosome? They are thread-like structures within each cell and are made up of genes. Genes provide the information that determines everything about people, from hair color to whether they are girls or boys.<br /><br /><br />Most people have 23 pairs of chromosomes, for a total of 46. But a baby with Down syndrome has an extra chromosome (47 instead of 46) or one chromosome has an extra part. This extra genetic material causes problems with the way their bodies develop.<br /><br /><br /><strong>Health Problems Are Common</strong><br /><br /><br />Babies with Down syndrome tend to develop more slowly than other babies do. They may start walking later than other babies. About half are born with <a href="http://kidshealth.org/kid/body/heart_noSW.html">heart</a> defects, which means there is something different with the way their hearts developed. Usually, these problems can be corrected by surgery.<br /><br /><br />Some babies also may have problems in their <a href="http://kidshealth.org/kid/body/digest_noSW.html">stomachs</a> or a blockage in their intestines that prevents them from digesting food properly. Kids with Down syndrome are more likely to get infections that affect their lungs and breathing. When they do get infections, they often last longer. They may have eye or ear problems or digestion problems like <a href="http://kidshealth.org/kid/stay_healthy/body/bowel.html">constipation</a>. Some may develop leukemia, a type of <a href="http://kidshealth.org/kid/health_problems/cancer/cancer_kinds.html">cancer</a>. Each person with Down syndrome is different and may have one, several, or all of these problems.<br /><br /><br />We've mentioned a little about the features people with Down syndrome often have. In addition to the eyes and face, they may have small or misshapen ears, a large space between the big toe and the second toe, and a crease that goes across the palms of their hands. It's important to note, though, that not all people with Down syndrome look alike or have all these features.<br /><br /><br /><strong>Do a Lot of People Have Down Syndrome?</strong><br /><br /><br />About one out of every 800 babies born has Down syndrome, no matter what race or nationality the parents are. It is not contagious, so you can't catch it from someone else. You are born with it. No one gets Down syndrome later in life.<br /><br /><br />Now you know that Down syndrome is caused by a problem with a chromosome. You might already know that we get our chromosomes from our mother and father. Remember the 23 pairs of chromosomes - half are from your mom and half are from your dad.<br /><br /><br />But doctors aren't sure why this chromosome problem happens to some babies. It's nothing the mom or dad did before the child was born. Anyone can have a baby with Down syndrome. But the older the mother, the greater the risk.<br /><br /><br /><strong>Is There a Cure?<br /></strong><br /><br />At one time, most kids with Down syndrome did not live past childhood. Many would often become sick from infections. Others would die from their heart problems or other problems they had at birth. Today, most of these health problems can be treated and most kids who have it will grow into adulthood.<br /><br /><br /><a href="http://kidshealth.org/kid/feel_better/things/kidmedic.html">Medicines</a> can help with infections and <a href="http://kidshealth.org/kid/feel_better/places/or.html">surgery</a> can correct heart, stomach, and intestinal problems. If the person gets leukemia, there are medical treatments that can be very successful. Someone with Down syndrome has a good chance of living to be 50 years old or more.<br />But there is no cure for Down syndrome. It is something a person will have all of his or her life. But scientists continue to do research in the hope of finding ways to prevent Down syndrome or at least improve the health and lives of people who have it.<br /><br /><br /><strong>What's Life Like for Kids With Down Syndrome?<br /></strong><br /><br />Many kids with Down syndrome go to regular schools and may attend regular classes. Some need special classes to help them in areas where they have more trouble learning. Their parents work with teachers and others to come up with a plan for the best way for each child to learn. Kids with Down syndrome like their playtime, too.
